In a recent interview, top-rated bankruptcy attorney Bryan Keenan, founding partner of Bryan P. Keenan & Associates in Pittsburgh, PA, revealed options available in filing for bankruptcy during the COVID-19 health crisis.

When asked to comment, Keenan said, “The economic downturn brought on by COVID-19 has left millions of Americans unemployed, putting many in a state of financial distress. Many people who were already in debt or are now just going into debt have a lot of questions about how they can wipe their debt slate clean in this new environment.”
Filing is still a possibility for anyone who is considering declaring bankruptcy.
When asked to elaborate, Keenan said, “During the COVID-19 outbreak, bankruptcy courts will continue to operate. The business handled by the courts will not be conducted in person but over the phone. This might lead to delays, particularly for new cases – but it's worth mentioning that new filers can still, in fact, declare bankruptcy and wipe their debt slate clean."
Another question in a lot of people’s minds is whether or not automatic stays will be implemented normally during the pandemic.
“Automatic stays will still take effect as they typically would. An automatic stay is legally put in place immediately after someone files for bankruptcy, and it halts creditors from trying to collect on any unpaid debt. This means that you won’t be hassled by creditors and collection companies if you file during the COVID-19 crisis,” he added.
According to Keenan, anyone who was in the process of filing before the COVID-19 outbreak should continue to keep track of their case.
“Progress on a case has probably slowed down significantly amid the pandemic if you’ve just filed or previously had a pending case. For instance, the majority of 341 meetings have been postponed. For certain things – such as the confirmation of Chapter 13 bankruptcies – are going ahead as planned via phone. The wheels of the courts continue to turn during this time.”
Even though there might be delays, Keenan added that there are still deadlines in place, such as submitting proof of bankruptcy education, filing fees, and other paperwork. Missing these deadlines could potentially slow down a case even further.
Congress recently made changes to the bankruptcy law by passing the CARES Act package, which could potentially affect those who are in the process of filing or those who have already filed.
When asked to explain further, Keenan said, “Some people are eligible to receive relief payments from the federal government during the COVID-19 crisis. The important thing to remember is that the relief payments have no bearing in calculating your income for both Chapter 7 and Chapter 13 cases.”
